The burgeoning of economic development in the western United States has resulted in a Ninth Circuit that is too large by several measures––geographical size, case load, and number of judges. The western United States has evolved since the creation of the Ninth Circuit. The Ninth Circuit needs to change to reflect the progress within its jurisdiction.
