Coming to Terms: Re-stating the Tentative Draft of the Restatement of Consumer Contracts

21 Wake Forest J. Bus. & Intell. Prop. L. 62

For better or worse, the rise of technology in the consumer
marketplace has undoubtedly changed the practice of consumer
contracting. Consumers, whether they are aware or not, regularly enter
into standard form agreements with businesses when purchasing goods,
software, services, and other products online. For instance, consumers
encounter these standard-form consumer contracts when purchasing
tickets to a concert, creating and using social media accounts,
subscribing to cable packages, ordering food online, and using mobile
phone applications. Accordingly, “most of us make more legal
agreements in a year than our grandparents made in a lifetime.”
